The process of a legal separation is similar to a divorce proceeding. In a legal separation case, the court can divide property and order payment of support. The court can also determine custody and parenting time issues even though the parties will remain legally married. Parties have various reasons for engaging in a legal separation, including if one’s religious beliefs do not permit divorce.
